Aprilia vs Spice Girls Fact Aprilia and spice girls had a contract to promote its Scooter.

On 31st May 1998, SG announced Geri's departure from the band in 27th May. On 8th June Aprillia faxed SG that it wouldn't consider the breach of contract by Geri's departure. But the deal flopped after the event. Aprilia refused to pay SG and SG filed a suit for nonpayment Aprilai claimed a damage of 1.6 million arguing that there is a implied misrepresentation. Issue Was the failure off SG to inform Aprilia that Geri would leave the band misrepresentation ? Legal question Spice girl made a misrepresentation by conduct. All five members were in photo shoot and other advertising activities despite knowing that Geri would leave the band. The high court's verdict was that no misrepresentation was there since Geri's statement was made during informal occasion. SG argued they believed that Geri would never leave the band. Decision: The court of appeal overruled High court's decision. It decided that the contract was induced by misrepresentation and Aprilia was entitled to claim damages and legal costs. Reasons Court was convinced that there was misrepresentation by conduct because all five members were in advertisement, deal was signed after they knew that Geri would leave. Laws applied:
