This is a horse boarding agreement between Sutton Stables, hereafter known as STABLE, located at 45311 Webster Road, Wellington, Ohio, and INERST NAME, hereafter known as Client, of INSERT ADDRESS, Home: INSERT or Cell: INSERT. This agreement is effective INSERT DATE. I. Client agrees to pay the amount of $450 per month for the board of one INSERT BREED & DESCRIPTION OF HORSE known as INSERT HORSES NAME beginning on INSERT DATE. II. Board includes and is limited to the shelter, and two feedings per day consisting of grain, hay, and water. Cleaning of the stall, shavings or stall bedding will be provided as part of the boarding agreement along with turn out of the horse five times each week. III. Any additional services, including but not limited to additional grain and/or hay above and beyond that normally consumed by the average horse, shall be extra and such charges shall be billed to Client monthly. Normal consumption for purposes of this agreement is considered to be a maximum of five pounds of grain per feeding and two flakes of hay per feeding. The evening closing consists of a small amount of grain, hay, and water for each horse and is not included in the above rations. IV. The boarding fee is due on the INSERT day of each month and shall be late after the INSERT DATE 5 DAYS AFTER DUE DATE day of the month. On the INSERT DATE 6 DAYS AFTER DUE DATE day of the month, a late charge shall be assessed at the rate of 10% of the monthly boarding fee. After the INSERT DATE 6 DAYS AFTER DUE DATE day of any month in which moneys are due Stable, a statutory lien, authorized by the Ohio Revised Code, automatically attaches to the subject horse and may become the temporary property of the Stable until all moneys are paid or the horse is sold at public auction. V. Such notice must be evidenced by a writing, signed and dated. VI. Stable reserves the right to provide any services necessary to maintain or protect the health, safety, or general welfare of the horses or when it is believed that services are necessary at the time and under the circumstances when such services are contracted for or provided. The Client will be strictly liable for all costs incurred by Stable, or any other, for providing services. These services shall include, but are not limited to a Veterinarian, Blacksmith, or employee of Stable. When time or circumstances permits, all reasonable efforts will be made to contact the Client, however, the Clients prior consent is not required. VII. This agreement gives Client privilege to the indoor riding barn, pasture, and outdoor ring areas only. This agreement does not give Client access or privilege to the personal residence or personal property of Stable. VIII. Client agrees to comply with all rules and policy requirements of Stable regardless of whether such rules are posted or verbally conveyed to Client. IX. Any damage caused by Client, any guest of Client or Clients horse to the facility, personal or real property, shall be the sole responsibility of the Client. Client shall compensate Stable whatever amount necessary to replace the thing damaged or to repair and restore to its prior condition. Moneys are due no later than thirty

(30) days after Client has received notice of the damage and an estimate of the cost of repair or replacement as determined by Stable, in its sole and absolute discretion. Should Client dispute the amount or the source of the damage or destruction, Client shall nonetheless deposit with Stable the amount demanded and Stable shall hold such moneys in trust until an equitable resolution has been agreed upon by the parties. X. No person shall knowingly bring, or permit any other to bring, a sick or diseased horse upon the grounds without a Veterinarians express statement that such illness or disease is not transmittable and will not endanger the health of any other animal. XI. This agreement does not provide for a definite period of time or duration and any party may terminate this agreement for any reason or no reason after providing the other party with thirty (30) days written notice. XII. This Contract is divisible and separable. Should any portion or provision of this contract be found by any court of competent jurisdiction to be unenforceable or void as against law or public policy, such portion or provision shall not affect the validity or enforceability of the remaining portions or provision. XIII. The Client agrees to indemnify and hold harmless Stable and its employees, agents or representatives for injury or death to any person or animal, or damage to any property, even when such injury, death or damage is the result of slight or ordinary negligence by any employee, member or representative of the aforementioned entities. The Client assumes all risks, both foreseeable and unforeseeable, of death, injury, damage, theft, fire of any other event or occurrence which may occur to a horse, equipment, property, and person. ________________________________________________ Client Signature ________________________________________________ Client Signature ________________________ Date ________________________ Date
